“THE BIG TAKE OFF SWEEPSTAKES” SPONSORED BY EMIRATES AIRLINE NO PURCHASE NECESSARY TO ENTER OR WIN A PRIZE. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID OUTSIDE OF THE FIFTY UNITED STATES AND THE DISTRICT OF COLUMBIA AND WHERE PROHIBITED OR RESTRICTED BY LAW. 1. Entry Period: “The Big Take Off Sweepstakes” (“Sweepstakes”) commences at 8:00 AM ET on May 23, 2016 and ends at 11:59 PM ET on September 30, 2016 (“Sweepstakes Period”). The Sponsor’s time clock will be the official time keeping devise for this Sweepstakes. All entries must be received by 11:59 PM ET September 30, 2016. All interpretations of these Official Rules and decisions made by Sponsor relating to the Sweepstakes are final. 2. Eligibility: The Sweepstakes is open to persons legally and physically residing in one of the 50 United States or the District of Columbia who are at least 21 years of age at time of entry. Sweepstakes Overview: There will be two (2) Sweepstakes Winners (hereinafter defined) and each will win a five (5) day trip to Dubai for two (2) and also get the opportunity to have a private office party hosted at their place of employ for up to twenty-five (25) co-workers (“Party”). All arrangements for the Party will be selected and provided by Sponsor and will take place at the applicable Winner’s place of employ. The Party will include: hors d-oeuvres; an afterwork happy hour; and a private movie screening for the attendees. The Party elements will mirror some of Emirates onboard/in-lounge offerings. As alcoholic beverages will be served, all Party attendees must be 21 years of age or older. In the event any Winner is not employed, arrangements to host a Party may still be made, in Sponsor’s sole discretion, and could include, among other things, hosting the Party at a volunteer organization that Winner is involved with. The ability to have the Party is subject to approval by each applicable Winner’s employer, or such other authorized individual associated with volunteer or such other organization, and each individual attending the Party must show proof of age and sign a Publicity Release/Waiver of Liability Release prior to attending Party. 4. To Enter Online or via Mobile Device: Visit emirates.com/bigtakeoff and complete all required fields on the online entry form and submit as requested and to receive one (1) entry into the Sweepstakes. Only fully completed entry forms are eligible. Message and data rates may apply if entrant enters Sweepstakes via mobile device. All information submitted by entrants is subject to and will be treated in a manner consistent with Sponsor’s Privacy Policy accessible at http://www.emirates.com/english/sitetools/privacy_policy.aspx. By participating in Sweepstakes, entrants hereby agree that Sponsor may collect and use their personal information in compliance with its Privacy Policy and acknowledge that they have read and accepted the Sponsor Privacy Policy. There is a limit of one (1) entry per email address. If it is suspected that an entrant submits more than one (1) entry, only one (1) entry will be considered. In the event of a dispute over who submitted a winning entry, the “authorized account subscriber” of the e-mail account used to participate in Sweepstakes at the actual time of entry, will be deemed to be the entrant. It is the sole responsibility of the entrant to notify the Administrator in writing if the entrant changes his or her email address during the Sweepstakes Period. The “authorized account subscriber” for online entries is defined as the natural person who is assigned an e-mail address by an Internet access provider, online service provider or other organization that is responsible for assigning email addresses for the domain associated with the submitted e-mail address. In the event a winning account selected is a joint account, a total of one (1) Prize will be awarded in the name of the first-named account holder. Proof to Sponsor’s satisfaction of being the authorized account subscriber may be required by Sponsor. All entries submitted in compliance with these Official Rules and not disqualified are considered “Eligible Entries”. All entries become the sole and exclusive property of Sponsor. Odds: The odds of winning the Sweepstakes depend on the total number of Eligible Entries received during the Sweepstakes Period. 6. Prizes: The Winners will each receive the following individual prizes and Party prizes collectively referred to herein as (“Prize” or “Prizes”): (a) individual prizing which will consist of: (i) two (2) roundtrip pairs of Emirates Airline economy class tickets for the Winner and one (1) guest of Winner (“Guest”) to fly from one of Emirates U.S. gateways (BOS, JFK, ORD, MCO, LAX, SFO, SEA, DFW, IAD or IAH) to Dubai, with an approximate retail value (“ARV”) of up to $2,600 per each Winner. (NO TRANSPORTATION WILL BE PROVIDED TO OR FROM THE EMIRATES U.S. GATEWAYS. Winner and Guest must travel on the same itinerary. Tickets are subject to issuer’s terms and conditions, including availability and expiration dates, and will not be replaced if lost or stolen. Trip must be redeemed and travel completed within one (1) year of award date); (ii) a Marhaba Gold “meet & greet” experience which is a personalized airport meet & greet service to guide Winner and their Guest through immigration and the arrival process, with an ARV of $296 for each Winner; (iii) five (5) nights hotel accommodations in Dubai for Winner and Guest, which will be one (1) standard room based on double occupancy (meals, telephone calls, tips, gratuities, and other incidentals and costs are not included), with an ARV of $2,400 per each Winner; and (iv) an Arabian Adventure experience for Winner and Guest which includes a private dune dinner safari and a traditional Dubai city tour, with an ARV of $140 for each Winner; and Party prizing (b) consisting of the opportunity to have Party hosted at Winner’s place of employ, or such other place as approved by Sponsor in its sole discretion, for up to twenty-five (25) co-workers (including Winner), which will include the following elements that will all take place on the same day: (i) a two (2) hour catered event offering savory and sweet hors d’oeuvres, with an ARV of $1,600 per each Winner; (ii) a two (2) hour after work happy hour (All participants must be 21 years of age or older), with an ARV of $1,800 per each Winner; and (iii) an in-office private movie showing, with an ARV of $1,880 per each Winner. All elements of Party will be offered only to the same group of twenty-five (25) attendees. Approval must be obtained in writing from each applicable Winner’s employer in order for the Party to take place. Each individual attending Party must show proof of age and sign a Publicity/Waiver of Liability Release prior to attending Party. All details of Party will be arranged by Sponsor and/or Administrator and the date must be mutually agreed upon by the parties. In the event that all of the Party elements of the Prize are approved, then each applicable Winner will also receive $1,584 issued in the form of a check in the Winner’s name which may be used by the Winner to offset his or her income taxes (or a portion of his or her income taxes) incurred when accepting the Prize. Should the Winner’s income taxes be higher than the $1,584, Sponsor and Administrator are not responsible for the difference between actual income taxes incurred. This exact tax off-set amount will be determined based on the Party elements that actually take place. In the event that not all Party elements occur, this amount will be adjusted accordingly. The total ARV of all of the Prize elements is $12,300 per each Winner (including the tax offset amount specified above). The total ARV of all of the Prizes is $24,600. NOTE: If Party cannot take place because Winner is unable to get approval from their place of employ or the Winner is not employed and does not have an organization approved by Sponsor at which a Party can be hosted, in lieu of Party elements of Prize, each Winner will receive a $2,000 local food service or cinema gift card (subject to the terms and conditions of gift card). The exact type of gift card awarded will be determined in Sponsor’s sole discretion. The ARVs are subject to change based on current market conditions at time of Prize fulfillment, and for the flight portion of the Prize, the time of travel and the distance between departure and destination. Any difference between the ARVs and the actual values, if any, will not be awarded. 7. Publicity Release: By participating in Sweepstakes, the Winners grant to Sponsor, and its representatives, affiliates, licensees and assigns, the right and permission to record, film, videotape and photograph the Winner (“Images”). These Images will be owned by Sponsor. Sponsor and each of its designees shall have the right to use, re-use, reproduce, publish, display, exhibit, distribute, edit, adapt, post, stream, copy and exploit such Images, and all elements embodied therein, including any names, likenesses, address, voice, conversation, biographical and Prize information and any other attributes of Winner, individually or with others, in whole or in part, in conjunction with other material, if any, in any and all media now known or hereafter devised, for the purpose of trade, advertising, publicity, promotion, or a Sweepstakes Winner List or any other lawful purpose whatsoever, in perpetuity, throughout the world, without additional compensation, consideration, notification or permission, except where prohibited by law. 8. Winner Selection and Notification: There will be two (2) Winners selected in a random drawing from among all of the Eligible Entries on or about October 3, 2016 by Sponsor’s independent promotion and advertising agency (“Agency”). Agency will attempt to contact the potential Winners via the email address they provided at time of entry and they will be required to send an email to Agency confirming his/her name, address and telephone number within five (5) business days from when email is sent. If a potential Winner does not confirm his/her contact information as required within the five (5) business day time period, an alternate potential Winner will be selected in a random drawing from among all remaining Eligible Entries received. Agency will then attempt to contact the potential Winners via the telephone number provided to confirm their eligibility. No messages will be left on answering machines or voicemail systems. If a potential Winner cannot be reached directly and/or does not meet the eligibility requirements, the potential Winner will be disqualified and an alternate potential Winner will be selected in a random drawing from among all of the remaining Eligible Entries. If a Winner is not available or able to accept the Prize, Winner privileges will be terminated and an alternate Winner will be selected in a random drawing from the remaining Eligible Entries if time permits. 9. Winner Verification: To be eligible to be declared a Winner and to receive the Prizes, the potential Winners must sign and return to Administrator or Agency, within seven (7) days of issuance of such documentation, a complete and valid IRS Form W9 and an Affidavit of Eligibility and Release that: (a) releases Sweepstakes Entities from any and all liability, loss, claims, demands, and causes of action for personal injuries or death and/or damage to personal or real property, theft, loss, or any other harm suffered directly or indirectly from potential Winner’s participation in Sweepstakes, including, but not limited to, traveling to, preparing for and/or participating in any Prize related activity, or the acceptance, possession, or use or misuse of any Prize; and (b) except where prohibited by law, grants Sweepstakes Entities the right to use potential Winner’s name, picture and/or likeness, biographical information or voice for trade, advertising and publicity purposes, in any media now known or hereafter devised, throughout the world, in perpetuity, without additional compensation or consideration or notification. In addition, potential Winners must get approval from an authorized representative of their employer for Sponsor to host Party at their place of employ, which will include potential Winner presenting authorized representative with a Sponsor drafted agreement (“Agreement”) to sign that will allow Sponsor to host Party. Entry into Sweepstakes constitutes agreement to sign such release and attempt to get Agreement signed. If a potential Winner does not sign this release and get the Agreement signed and both returned within the time frame specified, the potential Winner may be disqualified and the Prize forfeited. When such documentation is properly executed and providing potential Winners are otherwise in compliance with the Official Rules, potential Winners will each be determined to be a Sweepstakes winner (“Winner” and collectively “Winners”). Guests participating in Prize with Winners will also be required to sign [the Guest’s parent or legal guardian if Guest has not reached the age of majority in the jurisdiction in which they reside (“Minor”)], a Liability/Publicity Release that must be returned along with the potential Winner’s documentation as provided in these Official Rules within seven (7) days of issuance. If any Guest is a Minor, he or she must be accompanied by his or her parent or legal guardian and such parent or legal guardian must be the applicable Winner. If a Winner chooses not to take a Guest or if any Guest does not sign the documentation as provided in these Official Rules within the time frame specified then the Guest elements of the Prize will be forfeited and the other elements of the Prize shall constitute full satisfaction of Sponsor’s obligation to award the Prize. Winners and Guests must have valid photo ID and any other required documentation prior to departure. Winners and Guests must also complete any additional legal documents provided by Administrator or Agency with respect to the Prizes and return them as instructed within the time frame specified or Winner may forfeit Prizes at Sponsor’s sole discretion. If a potential Winner is unable to participate in or accept the Prize or any portion of the Prize for any reason, Sponsor will have no further obligation to the potential Winner. Prize or Prize documents returned as undeliverable will result in forfeiture of Prize. Sponsor expressly reserves the right to delay the announcement of the Winners for any reason Sponsor deems necessary. In addition, Sponsor reserves the right to select an alternate Winner in the event that any potential Winner fails to comply with these Official Rules or fails to execute the documentation within the time frame specified. Winners and Guests agree to comply with all venue rules and regulations and agree not to act in an unsportsmanlike or disruptive manner. By participating in Sweepstakes, Winners and Guests acknowledge that Sweepstakes Entities have not and will not obtain or provide insurance of any kind relating to the Prizes and that Winners and Guests will be responsible for obtaining and paying for any form of insurance relating to the Prizes that Winners and Guests deem appropriate. 10. Prize Terms: The date for fulfillment of the Prized will be on or about October 2016 through October 2017, but subject to change in Sponsor’s sole discretion. If for any reason any Prize is unavailable or any Prize or related event is delayed, cancelled or postponed, or for any other reason, Sponsor reserves the right to modify the Sweepstakes in its sole discretion and award a substitute Prize, or portion of Prize, of comparable or greater value as set forth in these Official Rules. No substitution, transfer, assignment or cash equivalent of any Prize, or any portion thereof, is permitted by a Winner or a Guest. Sweepstakes Entities shall have no responsibility or obligation to a Winner or a Guest who is unable or unavailable to, or who does not for any reason, accept or utilize the Prizes. The Winner may be required to provide a credit card to the hotel to cover any incidental costs incurred. All costs and expenses incurred in association with the acceptance of Prizes not specifically listed above as part of the Prizes, including, without limitation; insurance, passports or other travel documentation, transportation (unless specified as being included), meals, snacks, beverages, incidentals, mini-bar, entertainment, tips, gratuities, souvenirs, personal expenses, damages to hotel rooms, hotel, resort or property fees, such as telephone/internet charges, baggage fees, travel insurance, airport surcharges, departure taxes and fees, upgrades, and any equipment to be used in connection with the Prizes, are solely Winner’s responsibility. Sweepstakes Entities shall not be responsible for any damage to baggage or any cancellations, delays, diversions or substitutions or any acts or omissions whatsoever by the air carriers, hotels or other transportation companies or any other persons providing any element of the Prizes or associated with the Prizes. PRIZES ARE PROVIDED “AS IS”. ENTRANTS ACKNOWLEDGE THAT SWEEPSTAKES ENTITIES HAVE NEITHER MADE NOR ARE IN ANY MANNER RESPONSIBLE OR LIABLE FOR ANY WARRANTY, REPRESENTATION OR GUARANTEE, EXPRESS OR IMPLIED, IN FACT OR IN LAW, RELATIVE TO THE PRIZES AND ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. Prizes pictured in online television, print advertising, and other Sweepstakes materials are for illustrative purposes only. Arrangements for the fulfillment of the Prizes, including all travel arrangements, will be made by Sponsor, Administrator or Agency. Flight tickets are valid on Emirates only and are non-extendable, non- transferable, non-re-routable, non-endorsable and non-encashable and shall at all times be subject to availability and Emirates Conditions of Carriage and applicable ticket conditions as set out on the Emirates website. Blackout dates, advance booking requirements and travel restrictions may apply. Availability is subject to factors such as weather, seasonality and space availability. The Winners and their Guests must travel together on the same dates/sectors on both outward and return journeys. If a Winner or Guest is unable to utilize the flights, no cash alternative will be provided. All travel documentation and visas must be up to date and are the responsibility of the Winners and Guests. Flight tickets do not include access to the Emirates Lounges Skywards miles are not accruable on the flights. Nothing in these Official Rules requires Emirates to provide transportation to any person except in accordance with: Emirates General Conditions of Carriage for Passengers and baggage and travel documents, including airline tickets and airway bills, issued by Emirates; Emirates Schedule of Operations in place from time to time; and the relevant immigration rules applicable to any ticket holder. Except in accordance with and subject to the limitations set out in the Warsaw Convention in 1929 (as amended by the Hague Protocol 1955), the Montreal Convention 1999, and its travel documents (including but not limited to airline tickets and airway bills), Emirates accepts no liability to any person for any liabilities, losses, claims, demands, costs or expenses arising directly or indirectly from the utilization of Tickets provided pursuant to the Sweepstakes. 11. Taxes: Any Winner with a Prize value over $600 must supply Sponsor and/or Administrator with their social security number. An IRS Form 1099 will be issued in the name of Winner for the actual value of the Prize awarded if the actual value of Prize is over $600. All federal, state and local taxes, and any other costs and expenses associated with acceptance or use of Prize not specifically provided for in these Official Rules are solely the Winner’s responsibility. 12. General Terms: Sweepstakes Entities are not responsible if Sweepstakes cannot take place, or if any Prize cannot be awarded due to delays, interruptions or failures due to acts of God, war, natural disasters, weather, acts or threats of terrorism, strikes, lockouts, labor disputes, work stoppages, fire, acts of government, or other events outside of the reasonable control of Sweepstakes Entities. If, for any reason Sweepstakes is not capable of running as planned, including, without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the reasonable control of Sweepstakes Entities, which, in Sponsor’s sole determination, corrupts or affects the administration, security, fairness, integrity or proper conduct of this Sweepstakes, Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend Sweepstakes or any part of the Sweepstakes. If Sweepstakes or any part of the Sweepstakes is terminated or modified prior to the closing date of the Sweepstakes, notice will be posted on emirates.com/bigtakeoff if time permits and the Prizes will be awarded to Winners to be selected in a random drawing from among all of the remaining uncorrupted Eligible Entries received prior to any such event, or in any manner that is fair and equitable as determined by Sponsor in its sole discretion. Sponsor reserves the right to modify and amend these Official Rules from time to time during Sweepstakes for clarification purposes. Failure by Sponsor to enforce any term of these Official Rules shall not constitute a waiver of that provision. Sweepstakes Entities assume no responsibility for and will disqualify entries that are: stolen, late, lost, illegible, incomplete, invalid, unintelligible, altered, tampered with, unauthorized, fraudulent, damaged, destroyed, delayed, misdirected, not received, postage due mail entries, or that have incorrect or inaccurate entry information, whether caused by any of the equipment or programming associated with or utilized in the Sweepstakes, or by any human, mechanical or electronic error that may occur in the processing of the entries in Sweepstakes, or other errors appearing within the Official Rules or in any Sweepstakes related advertisements. Sweepstakes Entities assume no responsibility for any typographical or other error in the printing of the offer, administration of Sweepstakes, errors in processing entries, identifying the Winners, in the announcement of the Prizes and Winners, and the delivery of the Prizes, any problems or technical malfunction of any telephone network or lines, mobile phone, computer systems, online systems, servers or providers, computer equipment, software, failure of any e-mail or players on account of technical problems or traffic congestion on the Internet or on any web site, or any combination thereof, including, without limitation, any injury or damage to entrant’s or any other person’s computer system/software or mobile phone or other portable electronic device related to or resulting from participation or downloading any materials in Sweepstakes. Use of any device to automate or subvert entry is prohibited and any entries received by such means will be void. No software-generated, robotic, programmed, script, macro or other automated entries are permitted and any entries received by such means will be void. THIS SWEEPSTAKES SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF NEW YORK.
