Information on how to participate, Sweepstakes Rules and General Terms and Conditions form part of these Sweepstakes Terms & Conditions. By registering or taking part in this Sweepstakes, all persons participating herein (the “participants”) agree to be bound by these Sweepstakes Terms & Conditions.
Sweepstakes Rules
1. The Sweepstakes is open to all individual members of the DISCOVERY Loyalty Programme (i) aged 18 and above as at the start of the promotional period, (ii) not prohibited in any manner by any person, entity, authority or law anywhere in the world from participating in this Sweepstakes or any similar Sweepstakes, (iii) that live in a jurisdiction in which GHA may legally conduct this sweepstakes without making any registration filing, posting any bond or otherwise secure prior approval from any governmental authority, and (iv) not being employees, or immediate family members of employees, of Global Hotel Alliance (GHA) (GHA Loyalty DMCC, GHA Services SA), GHA member brands, their agents, distributors and other parties which are involved and/or associated in organizing, promoting and/or conducting with this Sweepstakes. By participating in the Sweepstakes, you represent and warrant that you have met the eligibility criteria set out under these Sweepstakes Terms & Conditions and that you consent to the use by GHA of your personal information for feedback, promotional and marketing purposes.
2. The Sponsor of this Sweepstakes is GHA Services SA, 28 boulevard du Pont D’Arve, Geneva CH1205, Switzerland.
3. The promotional period runs from 17 October 2016 till 30 November 2016 , both dates inclusive (the “Promotional Period”).
4. Only entries that are complete and correct as deemed by GHA and its authorized employees and officers will be deemed as eligible. Participants shall participate in the Sweepstakes on his or her own account, and shall not submit forms or participate on behalf of other persons. Multiple submissions are not allowed. Participants are required to complete all of the questions on the survey form on the gha.com website and supply a valid email address. No purchase is necessary for participation. Winners will be drawn at random from all valid competition entries received.
5. Submission of entries must be made within the Promotional Period. Submission of entries must be received by no later than 1759 hours (GMT) of 30 November 2016. Proof of submission is not proof of receipt and GHA accepts no responsibility nor liability for entries that are illegible, lost, delayed, misplaced, misdirected or incomplete or cannot be delivered or entered for any technical or other reason.
6. Winners will be notified in writing within seven (7) working days from the Draw Date based on the submitted contact details. Winners shall ensure that they remain contactable at all times.
7. Prizes won are not transferable, or exchangeable or redeemable for cash. Winners are responsible for collecting in person any prizes won. Winners will be notified by GHA and/or its representative for prize collection.
8. The prizes are:
a. Grand Prize (1 winner): 18 nights at Outrigger Resorts for two people in a double standard room. The winner may pick at least 3 different properties, at most 9, of the 9 Outrigger Resorts (Outrigger Waikiki Beach Resort, Outrigger Reef Waikiki Beach Resort, Outrigger Guam Beach Resort, Outrigger Fiji Beach Resort, Castaway Island Fiji Resort, Outrigger Laguna Phuket Beach Resort, Outrigger Koh Samui Beach Resort, Outrigger Mauritius Beach Resort, Outrigger Konotta Maldives Resort) and can stay a maximum of 6 nights in the same property (nights must be booked consecutive). The prize includes economy flights for 1 continuous trip for two persons from the home city to Outrigger destinations and back with a value up to USD 14,000/- (including tax and any other additional charges). Should the value of the flights be less, no cash payment will be given for the difference.
b. Alternate Prizes (25 winners): Four nights at one Outrigger Resort (Outrigger Waikiki Beach Resort, Outrigger Reef Waikiki Beach Resort, Outrigger Guam Beach Resort, Outrigger Fiji Beach Resort, Castaway Island Fiji Resort, Outrigger Laguna Phuket Beach Resort, Outrigger Koh Samui Beach Resort, Outrigger Mauritius Beach Resort, Outrigger Konotta Maldives Resort) for two people This does not include travel to an Outrigger Resort. Participant is solely responsible to make arrangements and pay for travel. The winners are drawn by the selection of their favourite destination as entered in the sweepstakes.
9. The winners and their companions must hold a current and valid passport and any other relevant travel documentation required for travel to and entry to the respective countries where Outrigger Resorts are located. It is the responsibility of the winners to (i) organize and pay costs associated with obtaining visas for the travelling party and (ii) ensure that the travelling party is adequately insured including without limitation covering overseas medical costs.
10. To book the prize, the winner has to contact Outrigger Resorts at least two weeks in advance of the intended date of stay and stays may not occur later than 31 October 2017 , all subject to availability and blackout dates. No requests for extensions or replacements whatsoever will be entertained.
11. Winner is responsible for all taxes and fees associated with prize receipt and/or use.
12. The Trip is subject to air travel and hotel availability, holiday and black-out dates, and all other prize and travel restrictions. Prize Winner and his/her Guest will be required to have/present at least one major credit card or debit card in good standing or make a cash deposit upon check-in at the hotel. Prize Winner and his/her Guest must travel together on the same itinerary. Prize Winner and Guest (if applicable) are solely responsible for providing all necessary identification documents and will be responsible for obtaining all necessary travel documents (Passport, Visa, etc.). Items not specifically mentioned as being included as part of the Prize are the sole responsibility of the Prize Winner and his/her Guest including, but not limited to transportation, travel tax, tips, travel insurance, car insurance, room service, laundry service, additional meals, entertainment, ground transportation, baggage fees, hotel incidentals, local and long distance telephone calls, gratuities, personal items, government fees, gasoline, and all other costs and expenses not otherwise mentioned herein. If the Prize Winner chooses to take the Trip and/or attend an Activity without a Guest, the remaining elements of the Prize shall constitute full satisfaction of Sponsor’s prize obligation to Prize Winner and no additional compensation will be awarded. No cash equivalent for prize (or prize element) will be available. Prize is not transferable. However, Sponsor may, in its sole discretion, choose to substitute the prize (or prize element) for one of equal or greater value due to prize unavailability or for any other reason.
13. Prizes are not transferrable and are not redeemable for cash. No substitutions or exchanges of the prize will be permitted. However, GHA reserves the right to substitute a prize of equal or greater value for any prize if the intended prize becomes unavailable for any reason beyond its reasonable control. The prize is awarded “as is” and without condition, warranty of any kind, express or implied. Country, state, local taxes, which are associated with the receipt or use of the prize(s) are the sole responsibility of the winner. GHA’s decision is final and no correspondence will be entered into. To the fullest extent permitted by applicable law, GHA shall not be liable for any damage, injury or loss consequential or otherwise caused by participation in the draw or the suitability or use of the prize. Any legal recourse is expressly excluded.
14. Winners will be required to submit personally by no later than one month after their announcement as winners the following verification documents to be eligible to collect any prize: Valid DISCOVERY Membership Card and Passport bearing the Winner’s personal identifiable particulars. The award of prizes shall be subject to verification to the full satisfaction of the organisers. Prize(s) which remain unclaimed by any participant after such date shall be conclusively forfeited by such participant, and such forfeited prize shall be dealt with at the organiser’s discretion.
15. GHA’s decision on all matters relating to this Sweepstakes will be final, binding and conclusive on all persons participating in this Sweepstakes, and no correspondence will be entertained.
16. Any trademarks, graphic symbols, logos or intellectual property contained in any materials used in connection with this Sweepstakes, in particular that relating to the Sweepstakes prizes, are the property of their respective owners. Any dispute about the quality, and purposes of the goods and services must be resolved directly with the hotel and its respective outlets or the travel carrier.
GENERAL TERMS & CONDITIONS
1.
a. By entering into this Sweepstakes, each participant agrees that GHA, prize suppliers, and any of their respective parent companies, subsidiaries, affiliates, directors, officers, employees and agencies (collectively, the “Released Parties”) shall not be liable for injury, loss, claims or damage of any kind arising out of or in connection with participating in this draw/Sweepstakes, the participants’ acts omissions or negligence, and/or from the acceptance or use/misuse of the prize awarded. Each participant agrees to waive and release the “Released Parties” from the above-mentioned claims and liabilities. This includes, without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy, to the extent not prohibited by mandatory applicable laws.
b. To the maximum extent permitted by law, each participant and anyone entitled or agreed to act on his/her behalf, agrees to indemnify each of the “Released Parties” from any losses, damages, costs, expenses, claims or liabilities of any kind arising in connection with its participation in the Sweepstakes, to the extent not prohibited by mandatory applicable laws.
2. By participating in the Sweepstakes, participants hereby opt-in, and agree and authorize, GHA, to use at its discretion, without further compensation to the participants, any of their names, addresses and personal details
3. GHA may at its sole discretion modify these terms and conditions, make prize substitutions or cancel this Sweepstakes without prior notice to any person. Any prize(s) won or accepted shall be given out on an “as it is” basis and is not exchangeable or returnable, and the “Released Parties” expressly disclaims any warranties express or implied in connection with any prizes to the fullest extent permitted by applicable laws. The prize(s) may be subject to additional terms and conditions, and the participant agrees to comply with all terms and conditions applicable to the prizes.
4. GHA reserves the right to vary or modify these Terms and Conditions, or disqualify any participant or winner, in such manner as GHA deems fit, without giving notice or reason, and without any liability to the such participant or winner. In particular, no participant shall, or procure another person to, (i) tamper with the registration process or the operation of the Sweepstakes or the relevant website, (ii) participate in the Sweepstakes in any manner which creates or may create an anomaly in the scoring system or operation of the Sweepstakes, and/or (iii) breach these Terms and Conditions or any other applicable law or regulation.
5. GHA shall not be responsible for any breaches of contract or any actions or omissions on the part of suppliers nor be liable in any way to any party for any loss or damage arising in connection with this Sweepstakes, for any reason whatsoever, including but not limited to any delay in processing of entries, error in computing, any breakdown or malfunction in any computer system or equipment, any notice which is misdirected or lost in transit and any acts or omissions in connection with the use of, or the inability to use, the prize.
6. GHA reserves the right to pursue legal action against any person which it believes has undertaken fraudulent activities or other activities harmful or prejudicial to this Sweepstakes, the entry submission process or the relevant web site.
7. GHA shall not be liable for damage to a user’s phone or computer system in any way due to a user’s participation in the this Sweepstakes or downloading of any information in connection with the registration, including without limitation any server failure; lost, delayed or corrupted data or other malfunction.
8. GHA reserves the right, without prior notice and at any time to terminate or cancel the Sweepstakes, in whole or in part, or modify the Sweepstakes in any way, without liability to any person. If any part of the Terms and Conditions is held to be unenforceable or illegal, such illegal or unenforceable part shall be severed from the Terms and Conditions without affecting the validity of the remaining Terms and Conditions.
9. This Sweepstakes and the Terms and Conditions shall be governed by the substantive laws of Switzerland and each participant agrees to submit any claim, dispute or controversy to the exclusive jurisdiction of the courts of Geneva, Switzerland.
10. This Sweepstakes is void in all countries where it is illegal by law. Residents from such countries must not submit entries and any such entries that are submitted will not be accepted.
11. The organizers are GHA Services SA (“GHA”) with offices at Boulevard du Pont-d’Arve 28, 1205 Geneva, Switzerland. All decisions made by GHA in all matters regarding this Sweepstakes are final and binding on the participants.
12. This Sweepstakes is conducted under the exclusion of any legal recourse.
